AN OPEN LETTER
What you should know first is that I love
the challenges of business. It is why I entered the law. It was as a
businessman working with both public and closely held corporations that I
came to appreciate how poorly lawyers understand the needs of business. I
am sure that you have heard the typical lawyer-speak about being "unable
to predict the outcome." It's enough to drive one crazy. Although legal
outcomes cannot be guaranteed, they can most certainly be predicted. As a
business person, what you are looking for is clear guidance; not some
attorney who is covering his hind-parts. We will give you that guidance.
Second, I understand that you have an objective to achieve. Although
the law is dominated by procedure, you could probably care less. Your
bottom line is:
(1) Where are we?
(2) How are we going to get this resolved?
Your only interest in learning the nuances of the law is in
understanding how they affect you.
Third, your objectives must be pursued. My first job is to inform you.
My second job is to counsel you. My third job is to follow your direction;
whether that be an aggressive legal assault/defense, or just buying time.
After all, you are the one who knows what it is you need to accomplish.
